GENERAL CONDITIONS FOR TRAINING

These General Terms and Conditions apply to all courses, training and workshops from TS NAILS BV. You agree to this if you purchase a course, training or workshop from us.

1. Definition

  • Student: the person who participates in a course, training or workshop of TS NAILS BV.
  • Client: the party (private individual, company or organization) that (wants to) conclude an Agreement with TS NAILS.
  • Course, Training or Workshop: a Course in which you can participate through a purchase via the webshop or in our store.

2. Establishment of education, training and workshop

2.1 The agreement between TS NAILS BV and the student or client is concluded by registration by the student or client on the website or by a purchase in the store. Confirmation of the agreement will be sent by e-mail.

2.2. When a student or client registers for a course, training or workshop, he or she has a 14-day reflection period. During that period, the student or client can cancel free of charge. This right does not exist if the education, training or workshop has started before the period of 14 calendar days has expired.

2.3. If the course fee has already been paid at the time that a valid appeal for withdrawal is made, TS NAILS BV will refund the course fee to the student or client within 14 calendar days after receipt of the withdrawal statement.

2.3. If TS NAILS BV confirms the registration, this is no guarantee that the education, training or workshop will continue. TS NAILS BV may decide to cancel the education, training or workshop if there are insufficient participants.

3. Cancellation policy

3.1. Cancellations by the student must be reported in writing to TS NAILS BV.

3.2. If a student moves a registration (to another date) after the cooling-off period has expired, it is equivalent to cancellation.

3.3. Cancellation costs for education, training or workshop:

  • If you cancel within 14 days of registering for the course, training or workshop, no costs will be charged. This right does not exist if the education, training or workshop has started before the period of 14 calendar days has expired.
  • In case of cancellation between 8-13 weeks before the start date of the education, training or workshop, the costs are: 20%.
  • in case of cancellation between 4-8 weeks before the start date of the education, training or workshop, the costs are: 35%
  • in case of cancellation between 2-4 weeks before the start date of the education, training or workshop, the costs are: 50%
  • in case of cancellation within 2 weeks before the start date of the education, training or workshop, the costs are: 75%

3.4. In the event of cancellations by the student due to an accident or death in the immediate vicinity, a suitable solution will be sought in consultation.

3.5 In case of cancellations by the student due to illness or health problems, a doctor's note must be submitted. If TS NAILS BV receives this doctor's note, a suitable solution will be sought in consultation. If TS NAILS BV does not receive this doctor's note, the above cancellation costs apply, as described in article 3.3.

3.6. TS NAILS BV reserves the right to cancel a training if there are insufficient registrations. Students will be informed about this at least 1 week in advance.

3.7. In the event of cancellation by TS NAILS BV, we will consult with you to find a new date. If the student is unable to take the course on the new date, the payment obligations of the student or client will lapse. If payment has already been made, the amount will be refunded to the student or client.

4. Warranties

If the trainer is unexpectedly unable to attend a course, training or workshop, TS NAILS BV will provide a suitable replacement. This is not a valid reason for the student or client to cancel the education, training or workshop. The student or client is not entitled to reimbursement of the costs.

5. Force majeure

In the event of circumstances over which TS NAILS BV has no influence, which mean that it cannot or cannot fully fulfill its obligations to the student (force majeure), the course, training or workshop will be moved in close consultation with the student. TS NAILS BV can also decide to convert the physical education, training or workshop to a digital training, if this is possible.

6. Completion of education or training

6.1. Each education or training usually ends with a test and practical assignment. Upon successful completion, the student will receive a diploma and/or certificate stating this.

6.2. If the student does not sufficiently complete the test or practical assignment, a one-time resit will follow.

6.3. If the student successfully completes the resit, he or she will still receive a diploma and/or certificate.

6.4 If a student does not sufficiently complete the test or practical assignment after the resit, the student will receive a 'Proof of Participation', provided that the student has participated in the course or training.

7. Payment terms

7.1. Some courses or training can be paid in 2 installments. If the student or client chooses this option, full payment for the education or training must be made no later than 1 week before the start of the education or training.

7.2. If the student or client has not paid the amount due in full within the stated payment term, the opportunity to participate in the course or training will lapse. Under no circumstances is the student or client entitled to a refund of the part of the course or training already paid.

8. Liability

8.1. TS NAILS BV will carry out its work to the best of its ability. TS NAILS BV carefully compiles course materials. However, TS NAILS BV cannot guarantee the completeness and accuracy of this course material. TS NAILS BV therefore accepts no liability for damage resulting from any decision or action based on the course material. 

8.2. TS NAILS BV accepts no liability for any damage resulting from its services. TS NAILS BV is also not liable for material damage and personal injury caused by its training activities.

8.3. TS NAILS BV is never liable for indirect damage, consequential damage, missed savings, lost income, damage due to business stagnation and immaterial damage, including damage as a result of the course material not being made available or not being made available on time or not being provided in full or in part. education, training or workshop, any incompleteness or errors in the course material or education, training or workshop and the loss of course material. The student also indemnifies TS NAILS BV against claims from third parties in this regard, unless any damage is the result of demonstrable intent or gross negligence on the part of TS NAILS BV

8.4. Any liability of TS NAILS BV is at all times limited to the amount paid out in the relevant case under the liability insurance of TS NAILS BV. TS NAILS BV will not be held liable if the student or client has the option to claim the damage incurred directly from his own insurance company. TS NAILS BV assumes that the student or client will arrange appropriate insurance themselves.

9. Course Materials and Ownership

9.1. The intellectual property of the course, training or workshop and any associated written and/or digital course material relating to a course, training or workshop are copyrighted by TS NAILS BV or - if applicable - by the persons appointed by TS NAILS BV have been appointed to provide an education, training or workshop. The student or client may only use the training material for their own use and with explicit reference to the source.

9.2. The student or client is not permitted to sell, change, reproduce, or modify the content of a course, training or workshop or the course material without written permission from TS NAILS BV. to make it available to third parties and/or to make it public. In the event of any form of direct or indirect infringement by the student or client, TS NAILS BV will take legal action and impose an immediately payable fine for each violation.

10. Confidentiality and personal data

10.1 When registering for a course, training or workshop, the student or client is obliged to correctly provide his name and other personal and/or company details. The student or client is fully responsible for (the accuracy of) the personal and/or company data provided.

10.2 In the context of the General Data Protection Regulation, the personal data provided by the student or client, such as name, address, place of residence and contact details, are included in the automated customer administration of TS NAILS BV. How we handle this data is described in our privacy policy.

10.3 TS NAILS BV, its employees and/or third parties engaged by TS NAILS BV will treat the information provided by the student or client confidentially. TS NAILS BV will not use the personal data for purposes other than those for which they were obtained.

11. Complaints and disputes

If the student has a complaint about the services of TS NAILS BV, TS NAILS assumes that the student will first discuss this with the trainer or teacher. If, in the student's opinion, this is an insufficient result, the student can submit a complaint in writing (letter or e-mail) to:

The complaint is read and assessed immediately upon receipt. If possible, the student will be contacted immediately (within 5 working days) to see if we can find a solution together. Naturally, the complaint will be treated confidentially.

If no solution is reached or matters need to be investigated, an agreement will be made regarding the timeframe for a response. The trainer provides the necessary information and adheres to the agreed working method.

The complaint and the method of handling are registered and kept for a period of 1 year.

12. Adjustment of General Terms and Conditions

7.1. TS NAILS BV may change the General Terms and Conditions at any time. TS NAILS BV will inform the student or client of the intended change before it takes effect, either via an e-mail or by other reasonable means.

7.2. Changes will come into effect four weeks after the announcement or on a later date stated in the announcement, unless a written objection is lodged against any changes within four weeks of the date of the change.

13. Final provisions

13.1 Dutch law applies to these general terms and conditions of training and an agreement between the student or client and TS NAILS BV.

13.2 Any disputes arising from or related to an agreement and/or education, training or workshop will be settled exclusively by the competent court in the district where TS NAILS BV is located.
