GENERAL CONDITIONS FOR TRAINING

1. Who do these terms and conditions apply to?

These terms and conditions apply to all courses, training and workshops of TS NAILS BV. By purchasing a course, training or workshop, you agree to these.

2. Important concepts

  • Student : someone who participates in a course, training or workshop.

  • Client : the person who books a training course, workshop or course (this can be a private individual, company or organisation).

  • Education, training or workshop : a course that you can purchase through our webshop or store.

3. Registration and cooling-off period

  • Your registration is final once you've purchased a course, training, or workshop. You'll receive a confirmation email.

  • You have a 14-day reflection period, during which you can cancel free of charge, unless the course has already started within this period.

  • If you cancel within the cooling-off period and have already paid, you will get your money back within 14 days.

  • TS NAILS BV reserves the right to cancel a training course, training, or workshop if there are insufficient participants. You will be notified of this at least one week in advance.

4. Cancel and move

  • Cancellation must be made in writing .

  • If you wish to reschedule a course, training or workshop after the cooling-off period, this will be considered a cancellation.

  • Cancellation costs:

    • Within 14 days of registration: free cancellation (unless the course has already started).

    • 8-13 weeks before start date: 20% of the costs.

    • 4-8 weeks before start date: 35% of the costs.

    • 2-4 weeks before start date: 50% of the costs.

    • Within 2 weeks before the start date: 75% of the costs.

  • In the event of illness or emergency situations (such as an accident or death), we will work with you to find a solution. A doctor's note is required for illness. If TS NAILS BV does not receive this doctor's note, the cancellation fees listed above will apply.

  • If TS NAILS BV is unable to (fully) fulfill its obligations due to unforeseen circumstances (force majeure or insufficient registrations), a new date will be sought in consultation with the student. If possible, an in-person training session or workshop can be converted into a digital version.
  • If a teacher is unexpectedly unable to attend, TS NAILS BV will provide a suitable replacement. This is not grounds for canceling the training, course, or workshop, and there is no right to a refund.
  • In the event of cancellation by TS NAILS BV or by you, we are not liable for any cancellation fees or other costs related to a booking for an overnight stay and/or for the training, course, or workshop. Students are responsible for arranging adequate cancellation insurance and making clear arrangements at the time of booking to ensure that cancellation is possible at short notice.

5. Payment

  • Some courses or training programs can be paid in two installments. The full amount must be paid no later than one week before the start date.

  • If you do not pay on time, you will not be able to participate and you will not receive any money back.

6. Completion and certificate

  • Most courses and training programs conclude with a test and practical assignment.

  • If you achieve sufficient results, you will receive a diploma or certificate.

  • If you fail the exam, you'll have one resit. If you fail the resit, you'll receive a certificate of participation (provided you completed the course).

7. Liability

  • TS NAILS BV makes every effort to provide the best possible training and courses, but is not responsible for any damage caused by errors in course materials or training.

  • TS NAILS BV is not liable for injury, material damage or other consequential damage.

  • TS NAILS BV is never liable for indirect damages, such as lost revenue or business interruption. TS NAILS BV also cannot be held liable for damages resulting from the unavailability (or untimely availability) of a course, training, or workshop. The student indemnifies TS NAILS BV against claims from third parties, unless there is intent or gross negligence.
  • TS NAILS BV's liability is always limited to the amount paid out by their liability insurance. If the student or client can recover damages through their own insurance, TS NAILS BV is not liable. We assume that the student or client will arrange for appropriate insurance.

8. Use of course materials

  • All course materials and teaching materials are the property of TS NAILS BV and may not be copied, sold, modified, shared, or distributed without permission. The student or client may use the materials solely for their own use, with explicit attribution.

  • Violation of this may result in legal action and a fine.

9. Privacy and data protection

  • When you register, we ask for your personal data, which we treat confidentially in accordance with our privacy policy.

  • Your data will only be used for the administration and communication regarding your education, training or workshop.

10. Complaints

  • If you have a complaint, please discuss it with the teacher first.

  • We will contact you within five working days to find a solution.

  • If there's no immediate solution or if further investigation is required, we'll agree on a timeframe for a response. The teacher will gather the necessary information and follow the agreed-upon procedure.
    The complaint and its handling will be recorded and kept for a maximum of one year.

11. Changes to the terms and conditions

TS NAILS BV may amend these terms and conditions and will notify you in a timely manner by email or another method. Amendments will take effect four weeks after publication, unless you object in writing within that period.

12. Applicable law

  • Dutch law applies to these general terms and conditions for training courses.

  • Any disputes will be handled by the competent court in the district where TS NAILS BV is established.
